By downloading, installing, or using SpeakUp ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Description of Service

SpeakUp is a public speaking practice app that uses AI to analyze your speech and provide feedback. The service includes:

• Speech recording and transcription
• AI-powered analysis and feedback
• Practice history and progress tracking
• Premium subscription features

3. Subscription Terms

3.1 Free Trial

• New users receive one (1) free practice session
• No payment required for the free session
• No automatic enrollment in paid subscription

3.2 Premium Subscription

• Price: $7.99 USD per month
• Provides unlimited practice sessions
• Automatically renews monthly unless cancelled
• Payment charged to your Apple ID account
• Renewal occurs 24 hours before the end of the current period
• Cancel anytime in your Apple ID Account Settings

3.3 Refund Policy

• Refunds handled according to Apple's App Store refund policies
• Contact Apple Support for refund requests
• We cannot process refunds directly

4. User Obligations

You agree to:

• Provide accurate account information
• Use the App only for lawful purposes
• Not reverse engineer or attempt to extract source code
• Not use the App to harm others or violate their rights
• Not upload malicious content or spam

5. Content and Intellectual Property

5.1 Your Content

• You retain ownership of your recorded audio and practice data
• You grant us license to process your audio for AI analysis
• We do not claim ownership of your content
• You can delete your content at any time

5.2 Our Content

• The App, including design, features, and AI models, is our intellectual property
• SpeakUp name, logo, and branding are our trademarks
• You may not copy, modify, or distribute our content

6. AI Analysis Disclaimer

• Results may not be 100% accurate
• AI analysis should not replace professional coaching
• We do not guarantee specific improvement outcomes
• Use AI feedback at your own discretion

7. Privacy and Data

• Your use of the App is governed by our Privacy Policy
• We collect and process data as described in the Privacy Policy
• Audio recordings are processed by third-party AI services (OpenAI, Anthropic)

8. Limitation of Liability

• The App is provided "as is" without warranties
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for the subscription
• We are not responsible for third-party service failures (OpenAI, Anthropic, Firebase)

9. Account Termination

We reserve the right to:

• Suspend or terminate accounts that violate these terms
• Modify or discontinue the service with notice
• Remove content that violates our policies

You may terminate your account at any time by:

• Deleting the App
• Cancelling your subscription in Apple ID settings
• Contacting us to delete your data

10. Changes to Terms

• We may update these terms at any time
• Changes will be posted with a new "Last updated" date
• Continued use after changes constitutes acceptance
• Material changes will be notified via the App or email

11. Governing Law

• These terms are governed by the laws of Japan
• Any disputes shall be resolved in the courts of Japan
